Red Flag Agreements, Contracts, & Clauses
What kinds of contracts, agreements, and clauses can affect our compliance obligations?
There are multiple types of contract clauses that can trigger export control issues for Baylor.
Here are some, but not all, of them:
- Sponsored research agreement with publication restrictions (beyond the nominal 90 day review)
- Sponsor restrictions on disclosure of the research results
- Research agreements that limit individuals from participating on the project
- Non-disclosure agreements
- Material transfer agreements
- Technology transfer agreements
- Indications from the sponsor or others that export-controlled information or technology will be furnished for use in the research
- Any agreements that specify export controls or international trade compliance.
Do not sign any such agreements without first consulting the Office of Export Compliance.
